These terms apply to your use of Pod is Life (the “site”), run by Pod is Life (“we”, “us”). By using the site you agree to them. If you don’t agree, please don’t use the site. Our Privacy Policy explains how we handle personal information.
1. What Pod is Life is
Pod is Life publishes podcast rankings built from public charts and directories, plus editorial picks such as our monthly Top 10 and featured shows. Rankings are calculated as described in How Our Rankings Work. We don’t sell chart positions. Featured placements are labeled and never change the numbered rankings.
Pod is Life is independent. We are not affiliated with, endorsed by or sponsored by Apple Podcasts, Spotify, Pocket Casts, Podcast Addict, Castbox, YouTube, Overcast, Patreon, or any other platform we mention. Their names and logos are trademarks of their owners and are used only to identify where data comes from or where to listen. Podcast titles, artwork and descriptions belong to their creators.
2. Rankings and information
Our data comes from third parties and can be delayed, incomplete or wrong. Platforms can change or stop publishing their charts at any time. The site is for general information. Don’t rely on it as the only basis for business, financial or legal decisions. If something about your show looks wrong, email admin@podislife.com and we’ll look into it.
3. Podcaster accounts
- You can claim a show only if you run it or are authorized by the people who do. We verify claims through the owner email in the show’s RSS feed, and we may also review claims ourselves.
- Keep your password and sign-in emails secure, and tell us right away if you think someone else has access to your account. You’re responsible for activity under your account.
- We may remove a claim or suspend an account if a claim is disputed or wrong, if these terms are broken, or to protect the site or other users.
- You can stop using your account at any time and ask us to delete it.
4. What you add to the site
Claimed shows can add a note and “If you like us, try…” picks. You keep ownership of what you write. You give us a non-exclusive, worldwide, royalty-free license to display it on the site and in related share cards and emails while it’s published. Don’t post anything that is unlawful, infringing, misleading, hateful, harassing or spam, or that includes someone else’s personal information. We may edit or remove content that breaks these rules.
5. Badges, share cards and embeds
You may download our share cards and embed our live badges to promote a show, including on your website and social media. Don’t change them to misstate a ranking, don’t suggest Pod is Life endorses you beyond the ranking shown, and keep the link back to us on embedded badges. We can change or withdraw badges and cards at any time.
6. Acceptable use
Please don’t:
- break the law, or infringe anyone’s rights, using the site;
- try to get into accounts or parts of the site you’re not authorized to use, or interfere with security features;
- overload the site, or copy large parts of our rankings or database with automated tools, without our written permission. Search engines may index the site as allowed by our robots.txt;
- misrepresent your connection to a show or to Pod is Life.
7. Our content
The site’s design, logo, the Pulse Score, our editorial writing and how we compile the rankings belong to us. You may link to any page and quote short excerpts with credit to Pod is Life. Anything else needs our permission.
If you believe something on the site infringes your copyright or trademark, email admin@podislife.com. Tell us what the work is, where it appears on the site, how to reach you, and include a statement that you’re the owner or authorized to act for them. We’ll respond promptly.
8. Links to other sites
We link to podcast apps, show websites and other services we don’t control. We aren’t responsible for their content or practices.
9. Disclaimers
The site is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We don’t promise the site will always be available or error-free.
10. Limitation of liability
To the fullest extent the law allows, we won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site. Our total liability for any claim relating to the site is limited to US$100. Some places don’t allow these limits, so they may not all apply to you. Nothing here limits liability that can’t be limited by law, or rights you have as a consumer that can’t be waived.
11. Indemnity
If you use the site to break these terms or the law, or post content that infringes someone’s rights, you agree to cover our reasonable costs from claims brought against us as a result, to the extent the law allows.
12. Changes and ending
We may update these terms. We’ll change the date at the top, and if a change is significant, we’ll show a notice on the site or email podcasters with accounts. Continuing to use the site after a change means you accept the new terms. We may change, suspend or stop any part of the site at any time.
13. Governing law
These terms are governed by the laws of the State of California, USA, apart from its conflict-of-law rules. Disputes will be handled in the state or federal courts located there, unless the law where you live gives you the right to bring a claim in your local courts.
